Can an employer dispute a workers’ compensation claim?

Many workers are not aware of their rights and some workers are afraid to file a work comp claim. Every worker should know and understand the benefits that they are entitled to under the workers’ compensation system if they become injured at work.

Workers’ Compensation Benefits

Injured workers are entitled to:

• medical benefits
• salary compensation
• total disability
• partial disability
• permanent disability

An injured employee may be denied one or more of these benefits because either the employer or the insurance company disputes the claim. Any employer that has a number of claims will pay higher premium rates for the insurance policy. To keep the rates low, an employer may not report all injuries or may simply deny the facts that are stated by the employee in the claim. An injured employee may hesitate to file a work comp claim for fear of losing their job.
